Welcome to FarmConnectAfrica.com (“the Platform”), owned and operated by Betatea Enterprises Limited. These Terms and Conditions (“Terms”) govern your access to and use of the Platform, including any content, features, and services offered.

By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

• “We,” “Us,” or “Our” refers to Farm Connect Africa.
• “User,” “You,” or “Your” refers to both registered suppliers and buyers accessing the Platform.
• “Supplier” means a registered business listing agricultural produce on the Platform.
• “Buyer” means a business or individual sourcing produce from suppliers via the Platform.
• “Produce” includes but is not limited to tea, coffee, avocados, macadamia, and other farm products.

2. Eligibility

To register and use FarmConnectAfrica.com, you must:

• Be at least 18 years old.
• Be a registered business or representative of a legally operating business.
• Agree to comply with applicable local and international laws, especially those relating to food safety, trade, and export regulations.

3. Platform Purpose

FarmConnectAfrica.com serves as a Business-to-Business (B2B) marketplace, enabling:

• Listing and promotion of African farm produce by suppliers.
• Discovery, connection, and communication between suppliers and buyers.
• Facilitation of inquiries and potential business deals.
  Note: We do not take ownership of listed products or directly engage in transactions unless otherwise pre-agreed or requested.

4. User Obligations

Suppliers Must:

• Provide accurate, complete, and up-to-date business and product information.
• Ensure listed produce meets relevant safety, quality, and legal standards.
• Respond promptly to inquiries from buyers.

Buyers Must:

• Conduct due diligence before entering into any agreement or transaction.
• Abide by fair trade practices and agreed payment terms.
• Use the Platform for legitimate sourcing purposes only.

5. Fees and Commissions

• Farm Connect Africa may charge subscription fees and or marketing commission on successful transactions facilitated through the Platform.
• Specific fees, terms, or premium listing packages may be introduced with prior notice to users.
• All fees are non-refundable unless stated otherwise.

6. Intellectual Property

All content, branding, logos, and features on FarmConnectAfrica.com are owned by or licensed to Farm Connect Africa or respective legal owner. Users may not copy, distribute, or exploit any part of the Platform without our express permission.

7. Prohibited Activities

You cannot:

• List fraudulent, misleading, or prohibited items.
• Use the Platform for illegal or unethical trade practices.
• Interfere with or disrupt the functionality or integrity of the Platform.
• Impersonate any person or misrepresent your business identity.

8. Disclaimer and Limitation of Liability

• We are not a party to transactions between users. All contracts, quality guarantees, and payments are the responsibility of the involved parties.
• We make no warranties about the accuracy, reliability, or completeness of user-submitted content.
• We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

9. Traceability and Compliance

Farm Connect Africa supports traceability and transparency in sourcing. Users are encouraged to maintain documentation and supply chain data. We reserve the right to verify listings and suspend accounts that do not meet our standards.

10. Privacy Policy

Use of the Platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal and business information.

11. Termination

We reserve the right to suspend or terminate your access to the Platform:

• If you breach these Terms.
• If required by law.
• If your conduct is harmful to the Platform or other users.

12. Modifications

We may update these Terms periodically. Continued use of the Platform after such updates constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Kenya. Any disputes shall be resolved in the courts of Kenya.
